General terms and conditions (AGB)

§ 1 scope

1. These general terms and conditions (GTC) apply to all orders of goods and services via our online shop at www.tgp-shop.com In their version valid at the time of the order.

2. Deviating conditions of the customer are not recognized unless we have expressly approved their validity in writing.

3. Subsidiary agreements, changes or additions to these terms and conditions require the written confirmation by a representative of TGP Moto Racing in order to be effective.

§ 2 contractual partner

1. The purchase contract is concluded with TGP Moto Racing, represented by the owner Thomas Nützl, Am Bach 4, 85659 Forstern.

§ 3 Contract conclusion

1. The presentation of the products in our online shop is not a legally binding offer, but a non-binding request to submit an order.

2. By clicking the "Buy" button, the customer gives a binding offer. A contract only concludes if we accept the offer by email or by sending the goods.

3. The automatically generated order confirmation is not an assumption, but only serves to provide information about the receipt of the order.

4. The customer can check and correct all entries before completing the order.

5. The contract is concluded exclusively in German.

6. The terms and conditions are available to the customer for access and storage on our website. The order data is sent to the customer by email.

§ 4 prices

1. All prices given are in euros and include the statutory VAT. Shipping costs and taxes are calculated separately by land.

2. The amount of the shipping costs depends on the delivery location, the weight and size of the package and is shown to the customer during the ordering process.

3. The price at the time of the order is decisive. Catalog prices may differ.

4. Additional tariffs or fees for international deliveries must be borne by the customer.

§ 5 goods available

1. If an ordered product is not available because, despite careful planning and without our own fault, we have not been supplied, we reserve the right to withdraw from the contract. The customer will be informed immediately and payments made will be reimbursed immediately.

2. Alternatively, a comparable product can be offered to the customer. The customer is not obliged to accept this offer.

§ 6 Payment conditions

1. Payment is made either by bank transfer, Sofortüberweisung, PayPal or in cash when you pick up in the shop.

2. For bank transfers, the invoice number must be specified as a purpose:

3. Open claims from previous contracts entitle us to only deliver to prepayment.

4. In the case of payments on third-party providers such as PayPal, their data protection and use conditions apply.

§ 7 Delivery conditions

1. The delivery takes place to the address provided by the customer. Deliveries to DHL packing stations are possible.

2. Delivery times:

   • Germany: 2–5 working days

   • International: 4–30 working days (depending on the target country)

3. There is no processing or delivery on public holidays.

4. Partial deliveries are permitted if they are reasonable for the customer. There are no additional shipping costs.

5. In the event of non -being (e.g. incorrect address, unauthorized refusal to accept), we reserve the right to withdraw from the contract.

§ 8 Warranty and Liability

1. The legal warranty rights apply.

2. For used goods, the warranty period is limited to one year.

3. Claims for damages by the customer due to slight negligence are excluded, unless they affect damage from the violation of life, body or health or essential contractual obligations.

4. In the event of violation of essential contractual obligations, liability is limited to the typical, predictable damage.

5. For racing parts:

   • The parts offered by TGP Moto Racing are sometimes only intended for use in racing and have no street approval.

   • These parts are used at your own responsibility. Liability for damage caused by racing is excluded.

   • It is the responsibility of the customer to have the technical suitability and security checked before use.

§ 9 Removal

1. The goods remain our property until full payment.

§ 10 Right of withdrawal of the consumer

Cancellation policy:

1. The customer has the right to revoke the contract within 14 days without giving reasons. The cancellation period begins with receipt of the goods.

2. To exercise the revocation, the customer must contact us in writing or by email:

3. Return costs: The customer bears the costs of the return, unless the goods are defective or incorrectly delivered.

4. A cancellation form is available on our website.

§ 11 Data protection

1. The provisions of our data protection declaration apply, available at www.tgp-shop.com/datenschutz.

2. The data protection guidelines apply to payments via third -party providers.

§ 12 applicable law and place of jurisdiction

1. German law, excluding the UN sales law, applies exclusively.

2. The place of jurisdiction for disputes is the seat of TGP Moto Racing (Erding District Court).

§ 13 Alternative disposal of dispute

1. The EU Commission offers a platform for online dispute resolution (OS), accessible at https://ec.europa.eu/consumers/odr/.

2. We are not obliged and are not ready to take part in a dispute settlement procedure in front of a consumer arbitration board.

§ 14 Exclusion for liability for racing parts

1. The one of TGP Moto Racing Parts and products offered are sometimes only intended for use in racing and have no street approval.

2. The customer notes that the use of these parts in racing carries increased risks and is exclusively at his own responsibility.

3. TGP Moto Racing assumes no liability for:

   • Material fatigue or break due to high loads.

   • Damage to vehicles, people or other objects.

   • Consequential damage through use in competition.

4. The legal warranty for racing parts is limited to defects that already existed during the handover. Liability for wear or damage caused by racing is excluded.
