General Terms and Conditions (AGB)

for all deliveries and services of the online shop of

TGP Moto Racing

§ 1 Scope

  1. These General Terms and Conditions (AGB) apply to all orders of goods and services through our online shop at www.tgp-shop.com in their valid version at the time of the order.

  2. Deviating conditions of the customer will not be recognized unless we have expressly agreed in writing to their validity.

  3. Side agreements, changes, or additions to these AGB require the written confirmation by an authorized representative of TGP Moto Racing to be effective.


§ 2 Contracting Parties

  1. The purchase contract is concluded with TGP Moto Racing, represented by the owner Thomas Nützl, Am Bach 4, 85659 Forstern.


§ 3 Conclusion of Contract

  1. The presentation of the products in our online shop does not constitute a legally binding offer, but rather a non-binding invitation to submit an order.

  2. By clicking the “Buy” button, the customer submits a binding offer. A contract is only concluded when we accept the offer by sending an order confirmation via email or by dispatching the goods.

  3. The automatically generated order confirmation does not constitute acceptance, but merely serves to inform about the receipt of the order.

  4. The customer can check and correct all entries before completing the order.

  5. The conclusion of the contract takes place exclusively in German.

  6. The AGB are available for the customer to retrieve and store on our website. The order data will be sent to the customer via email.


§ 4 Prices

  1. All prices quoted are in euros and include the statutory value-added tax. Shipping costs and taxes are calculated separately by country.

  2. The amount of shipping costs depends on the delivery location, weight, and size of the package and will be displayed to the customer during the ordering process.

  3. The price at the time of the order is decisive. Catalog prices may vary.

  4. Additional customs duties or fees for international deliveries are to be borne by the customer.


§ 5 Availability of Goods

  1. If a ordered product is not to be available, because we were not supplied despite careful planning and without our own fault, we reserve the right to withdraw from the contract. The customer will be informed immediately and any payments made will be refunded promptly.

  2. Alternatively, a comparable product may be offered to the customer. The customer is not obliged to accept this offer.


§ 6 Payment Terms

  1. Payment can be made optionally by bank transfer, immediate transfer, PayPal or in cash upon collection in the store.

  2. For bank transfers, the invoice number must be specified as the purpose:

  3. Outstanding claims from previous contracts entitle us to deliver only against advance payment.

  4. For payments via third-party providers like PayPal, their privacy and terms of use apply.


§ 7 Delivery Terms

  1. Delivery will be made to the address provided by the customer. Deliveries to DHL pack stations are possible.

  2. Delivery times:

    • Germany: 2–5 working days

    • International: 4–30 working days (depending on the destination country)

  3. No processing or delivery will take place on public holidays.

  4. Partial deliveries are permissible if they are reasonable for the customer. No additional shipping costs will be incurred.

  5. In case of non-deliverability (e.g., incorrect address, unjustified refusal of acceptance), we reserve the right to withdraw from the contract.


§ 8 Warranty and Liability

  1. The statutory warranty rights apply.

  2. For used goods, the warranty period is limited to one year.

  3. Claims for damages by the customer due to slight negligence are excluded unless they concern damages arising from injury to life, body or health or essential contractual obligations.

  4. In case of violation of essential contractual obligations, liability is limited to the typical, foreseeable damage.

  5. For racing parts:

    • The parts offered by TGP Moto Racing are partially intended exclusively for use in motorsport and do not have road approval.

    • The use of these parts is at the customer's own risk. Liability for damages arising from racing operations is excluded.

    • It is the customer's responsibility to have the technical suitability and safety checked before use.


§ 9 Retention of Title

  1. The goods remain our property until full payment is received.


§ 10 Right of Withdrawal for Consumers

Withdrawal Information:

  1. The customer has the Right to withdraw from the contract within 14 days without giving reasons. The withdrawal period begins upon receipt of the goods.

  2. To exercise the right of withdrawal, the customer must contact us in writing or by email:

  3. Return shipping costs: The customer bears the costs of return shipping, unless the goods are defective or faulty delivered.

§ 11 Data Protection

  1. The provisions of our privacy policy apply, available at www.tgp-shop.com/datenschutz.

  2. For payments via third-party providers, their privacy policies apply.


§ 12 Applicable Law and Jurisdiction

  1. Only German law applies, excluding the UN Sales Convention.

  2. The place of jurisdiction for disputes is the registered office of TGP Moto Racing (District Court of Erding).


§ 13 Alternative Dispute Resolution

  1. The EU Commission provides a platform for online dispute resolution (ODR), accessible at https://ec.europa.eu/consumers/odr/.

  2. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.


§ 14 Disclaimer for Racing Parts

  1. The parts and products offered by TGP Moto Racing are partially intended exclusively for use in motorsport and do not have road approval.

  2. The customer acknowledges that the use of these parts in motorsport involves increased risks and is done exclusively at their own risk.

  3. TGP Moto Racing assumes no liability for:

    • Material fatigue or breakage due to high loads.

    • Damage to vehicles, persons, or other objects.

    • Consequential damages due to use in competition.

  4. The statutory warranty for racing parts is limited to defects that already existed at the time of delivery. Liability for wear and tear or damage due to racing operation is excluded.
